1. Scope
These Terms apply to all digital products and services offered through Folio Supply (foliosupply.com) and associated third-party sales platforms (including LemonSqueezy, Etsy, and Gumroad). The operator is Dirk Mischke, operating as a sole proprietor (Einzelunternehmer) in Germany.
2. Products
Folio Supply sells digital products including document templates, spreadsheets, guides, and related business tools. All products are delivered as digital downloads (typically ZIP archives containing document files). No physical goods are shipped.
3. License and Permitted Use
Upon purchase, you receive a personal, non-exclusive, non-transferable license to use the digital products for your own business or personal purposes. You may:
- Customize, edit, and modify the templates for your own use
- Use the templates in client-facing documents (e.g., sending a proposal to a client)
- Print or share completed documents based on the templates
You may not:
- Resell, redistribute, or share the original template files
- Offer the templates (modified or unmodified) as your own product for sale
- Include the template files in any product or bundle sold to third parties
- Upload the templates to any file-sharing or template marketplace
4. Delivery
Digital products are delivered instantly after purchase through the respective sales platform. You will receive a download link via the platform's order confirmation and/or email receipt. It is your responsibility to download and save the files.
5. Refund Policy
Due to the digital nature of the products, all sales are generally final once the files have been downloaded. If you experience a technical issue (e.g., corrupted file, missing content), please contact us at hello@foliosupply.com and we will resolve the issue or provide a refund where appropriate.
EU consumers retain their statutory right of withdrawal (14 days), which may be waived upon immediate download with explicit consent, in accordance with ยง 356 Abs. 5 BGB and Art. 16(m) of the EU Consumer Rights Directive.
6. Intellectual Property
All template designs, content, guides, and spreadsheet formulas remain the intellectual property of Folio Supply. Your purchase grants a usage license as described in Section 3, not ownership of the underlying intellectual property.
7. Accuracy and Disclaimers
Products are provided as general business tools and templates. They do not constitute legal, financial, or tax advice. Spreadsheet formulas and calculators are provided for estimation purposes. You are responsible for verifying all figures and adapting content to your specific situation.
Products are provided "as is." While we strive for accuracy and quality, we make no guarantees regarding fitness for a particular purpose or specific business outcomes.
8. Limitation of Liability
The operator is liable without limitation for intent and gross negligence. In cases of slight negligence, liability is limited to breaches of essential contractual obligations (Kardinalpflichten) and to foreseeable, typical damages. To the extent permitted by law, liability for indirect damages, consequential damages, or loss of profits arising from the use of purchased products is excluded.
9. Third-Party Platforms
Purchases made through LemonSqueezy, Etsy, Gumroad, or other platforms are additionally subject to those platforms' own terms and conditions. Payment processing, tax collection, and order management are handled by the respective platform.
10. Modifications
We reserve the right to update these Terms at any time. Changes apply to purchases made after the updated Terms are published on this page.
11. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer within the EU, you additionally benefit from any mandatory provisions of the law of your country of residence.
